Terms of Service
Last updated October 13, 2026
These terms are an agreement between you and CloneKit for using clonekit.ai, our MCP server and our API. By creating an account or using CloneKit, you agree to them. If you don't agree, don't use CloneKit.
What CloneKit is
CloneKit is a marketplace of kits: packaged expert processes made by creators. Your own AI agent fetches a kit through our MCP server and runs it with your own tools. CloneKit serves kits; it doesn't run them.
Your account
- You must be at least 18, or the age of majority where you live, to use CloneKit.
- Give accurate information and keep it up to date.
- Keep your sign-in and API keys safe. You are responsible for what happens under your account, including what your agent does with it.
- If you use CloneKit for a company, you confirm that you may bind that company to these terms.
Your agent and your tools
You choose the AI agent, the model and the tools that run a kit, and you connect them under your own accounts with those providers. CloneKit isn't responsible for what your agent or tools do, including actions they take in your accounts, money they spend or messages they send. Review what your agent proposes before you approve it, and follow the terms of each tool you use.
Creators and their kits
- Creators own the kits they publish. Publishing a kit doesn't transfer its ownership to CloneKit or to buyers.
- Creators give CloneKit a license to host, review, display, distribute and promote their kits so we can run the marketplace.
- When you buy a kit, the creator gives you a personal license to use it under the kit's own terms. Unless the kit says otherwise, you may not resell, republish or share it.
- Creators confirm that they have the rights to everything in their kits and that their kits are accurate about what they do.
- Creators see aggregate numbers about their kits, never buyers' private data.
Review and removal
We review kits, including private kits, for malware, attacks and other harm, using automated tools and AI model APIs. We may refuse, hide or remove any kit, and suspend or close any account, that breaks these terms or puts buyers, creators or CloneKit at risk. Where it is safe to do so, we tell you why.
Acceptable use
Don't use CloneKit to:
- publish or spread malware, prompt injection or any kit designed to attack, deceive or harm the agents, tools or people that run it;
- steal secrets, credentials or data, or get into systems you aren't allowed to use;
- break the law or infringe anyone's rights, including intellectual property and privacy;
- attack, overload, scrape or reverse-engineer CloneKit, or get around its limits or security;
- commit fraud, including with payments or the balance.
Payments
Payments are processed by Stripe. You can pay by card, from your CloneKit balance, or both. Prices are in US dollars and are shown before you buy. Some kits are one-time purchases and some are subscriptions. Subscriptions renew until you cancel, and cancelling stops the next renewal.
Fees
Card processing fees pass through to the payer and are shown before you pay. Taxes may apply where the law requires. Creators' earnings and CloneKit's share are described in the creator settings.
Your balance
- You can top up a balance, and turn on auto top-up to refill it when it runs low. You can turn auto top-up off at any time.
- The balance is only for buying kits on CloneKit. It isn't cash, a bank account or a stored-value card.
- It can't be withdrawn, transferred to another account or exchanged for cash, and it earns no interest.
- The balance has a maximum, shown in your billing settings.
- If you close your account with money left in your balance, contact us and we handle it as the law requires.
Refunds
Refunds follow the terms of each kit, shown on its page before you buy. If a kit is removed for being malicious, or a charge was a clear error, contact us at francisco@clonekit.ai and we will make it right.
Our content
CloneKit's site, software, name and logo belong to CloneKit. These terms don't give you any right to them beyond using the service.
Privacy
Our Privacy Policy explains what data we collect and how we use it.
Disclaimers
CloneKit and every kit are provided “as is” and “as available”. Kits are made by creators, not by CloneKit, and we don't promise any result from running one. AI agents can make mistakes. To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the extent the law allows, CloneKit isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about CloneKit is limited to the greater of what you paid us in the 12 months before the claim, or US$100.
You agree to cover CloneKit for claims that come from your kits, your agent's actions or your breach of these terms.
Ending your use
You can stop using CloneKit and delete your account at any time. We may suspend or end your access if you break these terms. Sections that by their nature should survive, such as licenses already granted, payments owed, disclaimers and limits of liability, keep applying.
Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts located in Florida, and you and CloneKit agree to their jurisdiction.
Changes
We may update these terms. We change the date at the top, and for significant changes we tell you by email or on the site before they apply. If you keep using CloneKit after a change applies, you accept the new terms.
